Re Gulbenkian's Settlements (1970)
Last modified: Thu Feb 23 16:37:37 2006
[1970] AC 508 HL. A settlement provided a PowerOfAppointment
for the to be applied to
anyone who was providing accomodation or care for Mr Gulbenkian or
his family. There was a gift over in default of appointment. The issue
under consideration was whether this settlement provided sufficient
CertaintyOfObjects to be enforceable. The House of Lords held
that it did, because although it was not possible to enumerate all possible
beneficiaries of the appointment, it was alway possible to determine whether
a particular person was a potential appointee or not.
